Gavin Kemp Photography – Trading as Inked Identities – Terms and Conditions
1.0 Scope:
1.1 Inked Identities is a trading name of Gavin Kemp Photography Limited
1.2 These Terms only apply to Gavin Kemp Photography Limited – Trading under (or booked under) the trade name of ‘Inked Identities’.
1.3 These terms do not apply to commercial clients booking with Gavin Kemp Photography Limited trading as Gavin Kemp Photography Limited. These separate terms can be found via the Gavin Kemp.net website, or are available on request.
2.0 Exclusivity and Privacy
2.1 Inked Identities respects clients need for privacy, and will not share or use the photographs taken in a session in any way without the written permission of the client / portrait subject.
2.2 Inked Identities may occasionally request use of images for the purpose of promoting their own work across Inked Identities social media channels and website. To be compliant with GDPR this will be a separate agreement.
3.0 The Licence Granted
3.1 The licence granted to the client is a non exclusive perpetual licence (see note 2.0 above) allowing the use of the images for personal use only, this includes social media.
3.2 The commercial use of the images is forbidden, as is sale of the images.
3.3 Publication of the images by a 3rd party (magazine or website) requires the consent of Inked Identities to be obtained before publication. Inked Identities will not accept any liability arising from publication in any media.
4.0 Extent of Liability
4.1 Inked Identities shall not be liable to the Client for any loss of profit, loss of contracts, loss of business or revenues, loss of production or for any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of Inked Identities, it’s employees, agents or sub-contractors or otherwise) which arise out of or in connection with the shoot.
4.2 Inked Identities maximum aggregate liability for all losses, damages, costs, claims and expenses however or whenever arising out of or in connection with these Terms shall in any event be limited to the total amount of the fees paid to Inked Identities in relation to the relevant Assignment.
4.3 Not withstanding the above, nothing in these terms excludes or limits the liability of Inked Identities for death or personal injury caused by the Photographer’s negligence or that of it’s employees, agents or sub-contractors, for any fraudulent statement or act or for any matter which it would be illegal to exclude.
4.4 Inked Identities hereby disclaims any warranties, conditions and other terms on or relating to the services hereunder or any parts thereof which might otherwise be implied whether by statute, law, custom, course of dealing or otherwise, including without limitation any warranty, condition, or other terms of merchantability, quality, fitness for purpose or non-infringement to the fullest extent permitted by law.
5.0 Client Confidentiality
5.1 Inked Identities will keep confidential and will not disclose to any third parties or make use of material or information communicated to them in confidence for the purposes of the portrait session.
6.0 Location Hire
6.1 Location hire costs are estimated and agreed at the time of commission and charged accordingly. Where extra expenses or time are incurred by Inked Identities as a result of alterations to the original brief by the client or otherwise at their request, the client shall give approval to and be liable to pay such extra expenses or fees at Inked Identities normal rate in addition to the expenses agreed or estimated.
7.0 Refunds
7.1 The utmost care and attention to detail will be taken in the photographing and processing of each portrait session, however, due to the artistic nature of photography, the client has no right to request a refund or refuse agreed payment for their portrait session with Inked Identities on any subjective, stylistic or aesthetic grounds.
8.0 Termination
8.1 On-site, the Photographer reserves the right to terminate any photographic session without notice if they deem the client’s behaviour to be disrespectful or unsafe. Heavy rain or other unforeseen circumstances outside the control of Inked Identities may necessitate the cancellation or re-arrangement of a session.
9.0 Cancellation
9.1 Notice of at least 3 days must be given in order to receive a 100% refund, or free rescheduling. Notice of cancellation given between 3 days and 24 hours results in a 50% cancellation fee, and cancellations within 24 hours of the appointment incur a full 100% cancellation fee.
10.0 Travel Expenses
10.1 In any case where travel expenses will be charged, Inked Identities will notify the client beforehand, and a predicted travel cost will be included in the estimate given.
11.0 Examples
11.1 All images shown on this website and in any marketing material distributed by Inked Identities in print or digital form, are for illustrative purposes only. As such these examples are visual suggestions, and do not necessarily represent the exact photographic style of images which will be produced for any commissioned shoot.
12.0 Images/Data Supplied in Electronic Format
12.1 For all images / data supplied to the Client in electronic format (including but not limited to electronic mail, web based transfer services, and pen drive, etc.), Inked Identities will endeavour to do everything in its power to ensure that the data sent is not corrupt and is virus-free before despatch but cannot be held responsible for problems arising with third party services.
12.2 Inked Identities cannot be held responsible for any damage, disruption and/or loss of any kind that the said media may cause to the Clients computer or data. The Client agrees to take similar steps to ensure that data sent to Inked Identities is not corrupt.
13.0 Photography of Minors
13.1 Inked Identities only accepts bookings from adults over the age of 18 years for photography of adults with tattoos over the age of 18. Children will only be photographed with the written permission of, and in the presence of, a parent or legal guardian who are themselves being photographed.
14.0 Payment
14.1 A booking fee of 50% is to be paid at the time of booking
14.2 The balance of the fee is to be paid on the delivery of all finished work.
14.3 Inked Identities does not offer credit or act as a credit broker.
14.4 All photographs remain the property of Inked Identities until full payment is received.
15.0 Applicable Law
15.1 This agreement shall be governed by the laws of England, Wales, and Scotland. Variation: These Terms and Conditions shall not be varied except by agreement in writing.
Inked Identities Gift Vouchers Terms and Conditions
1. Inked Identities Gift Vouchers can be used in full payment for the specific named photography package they are purchased for, including any upgrades.
2. A voucher can not be redeemed for an alternative product, for example a voucher for a package can not be redeemed for a ‘solo’ product.
3. Gift Vouchers cannot be used for purchases made over the phone.
4. It is expected that a voucher will be used in full when a purchase is made. If you do not spend the entire value of a Voucher, your remaining balance will be issued as a new Gift Voucher for the specific items not purchased, and the old voucher will have no further monetary value.
5. Gift Vouchers cannot be used for the purchase of other gift Vouchers or vouchers.
6. GBP £ Gift Vouchers cannot be redeemed in ROI.
7. Inked Identities Gift Vouchers cannot be redeemed for cash.
8. All Gift Vouchers have an expiry date of 1 year from purchase, after this date redemption is at the discretion of Gavin Kemp Photography Limited.
9. The number of Gift Vouchers or eGift Vouchers you can use in a single transaction for online purchases is limited to 4. If you have more than 4 Gift Vouchers or eGift Vouchers and would like to use them in a single transaction you may do this at the discretion of Gavin Kemp Photography Limited.
10. Inked Identities Ltd reserve the right to decline or withdraw Gift Vouchers, and the right to amend these terms and conditions of Gift Vouchers at any time and to take appropriate action, including the cancellation of the Gift Vouchers, if, in its discretion, it deems such action necessary.
11. Gift Vouchers must be treated like cash, Inked Identities Ltd cannot be held liable for lost, stolen or damaged Gift Vouchers and they will not be replaced.
12. Sales of Inked Identities Gift Vouchers are made, managed and fulfilled by Inked Identities - a trading name of Gavin Kemp Photography Ltd, Registered Office West Side Factory, Belper Street, Ilkeston, DE7 5FJ.
13. Gift Vouchers will be sent by Inked Identities to the delivery address(es) stated on each individual order. Deliveries will be made using Royal Mail services. Orders will be sent by either Recorded Delivery or Special Delivery and will require a signature on arrival.
14. Gift Vouchers will normally be dispatched by Inked Identities within two working days unless a specified later delivery date is requested. Where possible we will try to meet all delivery requirements but Inked Identities shall not be liable for any loss incurred either directly or indirectly by failure to meet the delivery date and time indicated at the time of order being placed. ‘Loss’ in this instance includes loss of profit, costs, damages, charges or other expenses.
15. Risk will pass to the customer upon delivery and title will pass upon receipt of payments in full. Inked Identities can not be held responsible for lost, stolen or damaged gift Vouchers following delivery to the recipient. gift Vouchers will NOT be replaced or refunded if lost, stolen or damaged. Inked Identities is not responsible for funds on the Vouchers used without your knowledge.
16. Inked Identities Gift Vouchers cannot be exchanged for cash and cash refunds will not be available for products purchased with this Vouchers.
17. Gift Vouchers quantities should be checked immediately upon receipt. Any discrepancies must be notified immediately. Inked Identities cannot be held responsible for shortage or loss of any gift vouchers not notified to us within three days of delivery.
18. Cleared payment is required prior to the dispatch of orders. Payment is taken at the time of purchase. Your credit/debit Vouchers statement will read 'Gavin Kemp Photography Limited'. We reserve the right to decline any order without providing explanation. Inked Identities will not be given access to your credit/debit Vouchers details.
19. Inked Identities Gift Vouchers cannot be exchanged for cash. Gift Vouchers which are defaced, altered or cancelled will not be accepted.
20. The re-sale of Gift Vouchers sold by Inked Identities is strictly prohibited.
21. Force Majeure: Voucher Express cannot be held responsible for failure to meet its service obligations when any failure is brought about due to some cause totally beyond its reasonable control. Examples of this might include: acts of God, trade disputes; governmental intervention, fire, flood, and disruption to computer and IT infrastructure.
22. Breach of these conditions will entitle Gavin Kemp Photography Limited to seek the appropriate legal remedy available for injunction, damages or otherwise.
23. Your use of this website is governed by these Terms and Conditions and construed and enforced in accordance with the law of England and Wales. Disputes arising from your use of this website and the services we provide are subject to the non-exclusive jurisdiction of the English courts.
